All work on the Kiliavo Fresh was put to stop last year by the order of the national environmental regulator who had suspended its license.

The license suspension was a result of concerns raised by residents that the avocado form would interfere with their pastoral livelihood, at the same time, conservationists and landowners complained that it affects the wildlife habitats. It was argued by the conservationists that the farm would make Elephants move in and out of the Amboseli National Park.

The decision of the regulatory body was appealed against by the farm.

But the case was ruled against Kiliavo on Monday by the National Environmental Tribunal – the special court hearing the appeal – the farm located in Kimana, in Kenya’s south-west near the Amboseli park had already arranged a larger portion of the farm for the avocado farming after clearing part of the more than 100 acres (40 hectares) land and having it fenced.

Since the ruling, no statement had been issued by Kiliavo.

The decision of the tribunal might not put an end to the issue but it was a welcome stance, one of the organizations against the farm, Biglife Foundation, said.

In a statement the organization issued, it states that “the battle is likely not to have come to an end, but the ruling has shown that environmental health will be taken seriously by Kenya, as well as the wishes of local communities when negative consequences of ‘development’ led by corporate are facing them.”

The agricultural company had disclosed that residents are to also benefit from the farm and that it legally obtained the farm having bought it from a group ranch and with the acquisition of government approval.

Kenya’s avocado exports have grown rapidly in the last decade as one of the biggest exporters of avocado in Africa.
